These Terms of Service (the "Terms") govern the use of the GoGoCard system and set out the rights and obligations of the Service and the User. By opening a Personal Cabinet or making a first deposit, the User accepts these Terms and the Service's Internal Policies (the AML & KYC Policy, the Privacy Policy, the Cookie Policy and the Refund Policy), which are published on the Website and form an integral part of the agreement between the User and the Service.
Capitalised terms used in these Terms have the meanings given to them in Section 2.
1. General Provisions
1.1. These Terms constitute a public offer made by GGC – Technology Company Limited, registered in Dominica under licence AA00623, with its registered office at 3 Kennedy Ave, office 314, Roseau, Dominica ("GoGoCard" or the "Service"). Upon acceptance, these Terms shall constitute a binding agreement between the User and the Service.
1.2. These Terms, together with the Internal Policies, set out the conditions on which the Service provides the User with access to the Personal Cabinet, the GoGoCard system and the services of the Service (the "Services"), and the conditions on which the Service charges fees at the rates published on the Website.

Unless otherwise provided herein, all such channels form part of the Services.
1.4. Any matters not governed by these Terms shall be governed by the Internal Policies. Acceptance of these Terms constitutes acceptance of the Internal Policies by the User.
1.5. The content of the Website is provided on an "as is" basis for information purposes only. The Service does not warrant that such content is accurate, complete or up to date, and the User shall not rely on it as the sole basis for any decision.

3. Eligibility
3.1. In order to use the Services, the User must open a Personal Cabinet (Section 4) and complete verification (KYC).
3.2. The User must be at least 18 (eighteen) years of age and have full legal capacity under the laws of their country.
3.3. The Services are not provided to US Persons. By using the Services, the User confirms that they are not a US Person and do not act on behalf of a US Person. The Service takes reasonable measures to prevent the use of the Services by US Persons and may refuse service, suspend or close any Personal Cabinet where it establishes or reasonably suspects that its holder is a US Person.
3.4. The User may not open or use a Personal Cabinet if the User is a Restricted Person or if doing so would breach the laws of the User's country of residence. By opening a Personal Cabinet, the User confirms that doing so does not breach any law applicable to them. Should the use of the Services become unlawful in the User's country of residence, the User shall cease using the Services immediately.
3.5. The User acts solely on their own behalf and in their own interest.
4. Opening a Personal Cabinet and Verification (KYC)
4.1. To open a Personal Cabinet, the User completes the registration form on the Website, provides the requested information and accepts these Terms. The agreement between the parties enters into force upon such acceptance.
4.2. Upon registration, the Service requests the User's first name, surname, country of residence and email address.
4.3. In order to obtain full access to the Services, the User shall complete verification, for which only the following are required:
- a valid identity document (passport, national identity card or driving licence) indicating the issuing country. The country of issue shall be deemed to be the country (region) of the Personal Cabinet; and
- a selfie with a liveness check.
Proof of address is not required.
4.4. Verification shall be deemed failed if the information is not provided or proves to be false, incomplete or out of date.
4.5. Verification is performed automatically and is normally completed immediately, within no more than 1 (one) minute. Where the Service's system has any doubt, the documents are referred for manual review, which may take longer. Verification is deemed completed upon its confirmation by the Service in the application.
4.6. The User shall keep their information accurate and up to date and shall promptly notify the Service of any changes.
4.7. The Service may at any time request the User to confirm that their information remains accurate or to provide additional documents within 7 (seven) days. The Service may also at any time require the User to undergo verification again, irrespective of whether the User has previously been verified. Pending fulfilment of such request, the Service may suspend the User's operations and block or restrict the User's Card, Account or Personal Cabinet. Should the User fail to comply, the Service may cancel the verification, suspend or close the Personal Cabinet.
4.8. Where the Service at any time establishes or reasonably suspects that the User is a US Person or a Restricted Person, the Service may refuse or cancel verification, suspend or close the Personal Cabinet and terminate these Terms.
5. Personal Cabinet and Account
5.1. Upon completion of registration, a Personal Cabinet is created and the Applicant becomes a User.
5.2. The User's Personal Cabinet, Cards and the Funds held therein form part of the GoGoCard system and belong to GoGoCard. Funds deposited by the User are made available to the User on a perpetual, interest-free basis for use through the Services in accordance with these Terms. No interest accrues on the balance.
5.3. Limits may apply to deposits, payments and withdrawals depending on verification status, Account type and other risk factors. The applicable limits are published on the Website.
5.4. The User may sign in to the Personal Cabinet and access the Funds solely by means of the Login Details.
5.5. The User is responsible for maintaining the confidentiality of the Login Details. Any action taken using valid Login Details shall be deemed to have been taken by the User (Section 9).
5.6. By making a transaction that changes the Account balance, the User thereby confirms such balance.
5.7. The User may close the Personal Cabinet at any time, provided that the User has no outstanding obligations to the Service (Section 17).
6. Deposits and Withdrawals
6.1. The User may deposit Funds and make payments by any method made available by the Service, including crypto deposits, SBP or other methods available in the application. The methods available may vary depending on the User's location, status and risk profile and are subject to change.
6.2. Certain deposit and withdrawal methods are provided by third parties and do not form part of the Services. Such third parties may charge their own fees, and their own terms shall apply.
6.3. Cash withdrawals at ATMs are available only with physical plastic cards, within the limits applicable to such cards. Other withdrawal methods, where available, are displayed in the application and are subject to the User's limits and applicable checks.
6.4. The Service executes a transaction on the basis of the User's Payment Order submitted electronically through the Personal Cabinet. The Service identifies the User by the Login Details and may require additional checks before executing certain Payment Orders.
6.5. For security purposes, the Service sets deposit and withdrawal limits and may restrict certain methods for higher-risk activity. The applicable restrictions are published on the Website.
6.6. The Service may notify the User of transactions by email or in the application.
6.7. The User may transfer Funds between their own Accounts or to the Accounts of other Users of the same type.
7. GoGoCard Cards
7.1. Cards are optional and may be virtual or physical. Cards are issued by a third-party Issuer, not by GoGoCard. To obtain a Card, the User may be required to provide additional information to enable the Service and the Issuer to prevent money laundering, fraud and other risks. The User consents to the exchange of Card-related information between the User, the Service and the Issuer. Cards are issued in the User's name, and the User's name is printed on physical cards.
7.2. Cards are provided on a rental basis. The Service may suspend, cancel or replace a Card at its discretion, including in the circumstances set out in Section 10.
7.3. The Service acts as an intermediary transmitting information between the User and the Issuer. The Service provides Cards for rent for a fixed one-time fee. Card transactions, balance and history are displayed in the Personal Cabinet. Physical cards must be activated within 3 (three) months of receipt.
7.4. By using a Card, the User authorises the Service to deduct the amount of each transaction, together with any related fees and taxes, from the available USD balance. Card transactions in other currencies are converted into USD and may be subject to a foreign transaction fee.
7.5. Sufficient Balance. The User shall not initiate any Card transaction or Account operation where the balance is negative or insufficient to cover it in full. This requirement applies to all operations without exception, including online and offline purchases; recurring, subscription and pre-authorised payments; and adding or using the Card in any third-party wallet, service, store or platform (such as Apple Pay, Google Pay, Alipay or PayPal). The User shall ensure that a sufficient available balance is maintained prior to each operation. Should a transaction nevertheless be processed while the balance is insufficient, the User shall immediately settle the shortfall together with any related fees.
7.6. User's Responsibility for the Card. The User bears sole responsibility for the use of the Card, Personal Cabinet, Account and the Funds held therein; for every transaction; for adding or storing the Card in any third-party service, wallet or store; and for any payment made online or offline — irrespective of the Card's status (active, blocked, frozen, expired or cancelled). The User is responsible for all transactions made with the Card, including those made by any person to whom the User has granted access.
7.7. Compliance with MCC and Jurisdictional Restrictions. The User shall not use the Card in breach of the merchant category code (MCC), prohibited activity, country and region restrictions set out in the AML & KYC Policy, including by adding or using the Card in any third-party account, service or store whose registered or selected country or region is prohibited or restricted.
7.8. Declined Operations. Five (5) or more consecutive declined or failed operations may result in the Card being cancelled for security reasons.
7.9. Should the User lose a Card or have reason to believe that an unauthorised transaction may be made, the User shall immediately cancel the Card through the application or by contacting customer support. Cancellation, suspension or freezing of a Card may not take effect immediately, and the User remains responsible for transactions until it does. Upon cancellation of a Card, the remaining balance is returned to the User's Account, less any fees or third-party debts (if any).
7.10. The User shall not use a Card for any unlawful purpose. The Service may instruct the Issuer to suspend, cancel or freeze a Card or to restrict transactions on it.
8. Fees
8.1. The Service charges Fees for the Services. The amounts of the Fees and the manner in which they are charged are published on the Website.
8.2. The Service may amend the Fees by publishing new rates on the Website. Such amendments take effect upon publication.
8.3. Fees are calculated in the currency of the transaction and rounded to the nearest cent. The Services are not subject to VAT or similar turnover taxes.
8.4. The Service debits the applicable Fees from the Account upon completion of a transaction or upon otherwise becoming entitled to charge them. Where the balance is insufficient, the Service may decline the transaction.
9. Security of the Personal Cabinet
9.1. The User is responsible for maintaining the confidentiality of the Login Details (email address, phone number, Google account and any password or code) and for signing out at the end of each session, in particular on shared devices.
9.2. The User shall notify the Service immediately if the User believes that any person has gained access to the User's Personal Cabinet, email, phone or Card, or that any Login Details may have been lost or disclosed. Notification shall be sent to customer support or to legal@gogocard.me.
9.3. As the Service identifies the User by the Login Details, the Service shall not be liable for any loss arising from:
- the User granting any person access to the Personal Cabinet or failing to maintain the confidentiality of the Login Details;
- any person gaining access to the User's email, phone number, Google account or SIM card (including by phishing, SIM swap or malware) in circumstances beyond the Service's control;
- viruses or malware on the User's device.
This Section shall not limit the Service's liability for loss resulting from the Service's proven fault.
9.4. Provision of Information upon Request. The User shall provide complete and accurate information in response to any request from the Service's customer support or security (risk control) function. Pending provision of such information, the Service may suspend any of the User's operations and block or restrict the Card, Account or Personal Cabinet.
9.5. Holds and Checks. In order to protect the User and the system, the Service may suspend or hold an individual transaction where it suspects fraud, account compromise or a technical issue, and may require the User to undergo re-verification or provide additional information.
9.6. High-Risk Requests. The Service's customer support and security functions may decline any request that they reasonably consider to pose an increased risk to the security of the Services.
9.7. Non-Disclosure. For security reasons, and where required by law or a regulator, the Service may not disclose to the User the specific reason for a check, hold, block or refusal.
10. Suspension, Restriction and Closure of the Personal Cabinet
10.1. The Service's security function may, where it has sufficient grounds, block, restrict, freeze, unfreeze, cancel or close any Card, Account or Personal Cabinet, and may subsequently require the User to provide explanations regarding the relevant activity. Such grounds include, without limitation:
- genuine security concerns;
- suspected fraud or unauthorised use;
- suspicious activity of the User, or a breach by the User of these Terms, the Internal Policies or applicable law;
- a requirement of a court, regulator or law, or an investigation concerning the Personal Cabinet;
- failure by the User to confirm their information or to provide the requested documents;
- the User opening multiple Personal Cabinets;
- the Personal Cabinet becoming a Dormant Personal Cabinet;
- actions of the User capable of harming the Service's reputation or causing it loss.
10.2. The Service may apply such measures with or without prior notice. Where a balance remains on the account at the time of suspension, the User should withdraw it within a reasonable time, less any Fees. The Service shall lift the suspension once the grounds for it cease to apply.
10.3. Refusal of Service. The Service's security function may decide to cease providing the Services to the User. In such case, the Service shall send a final notice to the User's email address setting out the procedure for withdrawing any remaining balance and the period available to the User before the Personal Cabinet is closed. Where there are grounds to do so, and in order to protect the security of the Services, the Service may decline to disclose the reasons for a block or refusal.
10.4. Suspension or closure shall not release the User from obligations already owed to the Service. The Service shall not be liable to the User for suspending a Personal Cabinet and may retain and use transaction data relating to a suspended Personal Cabinet.
11. User's Obligations and Liability
11.1. The User is responsible for all transactions on the User's Account, including Card transactions and the actions of persons to whom the User has granted access.
11.2. The User shall be aware of and comply with the laws of their country governing the opening of accounts and the transfer of funds. The Service shall not be liable for any breach of such laws by the User.
11.3. Debt and Negative Balance. The User is liable for any debt or negative balance arising on the User's Card or on any of the User's accounts with the Service, and shall repay it upon demand of the customer support or security function within the period specified in the relevant notice. Should the User fail to make payment within such period, the Service may charge interest at the rate of 0.1% (zero point one per cent) of the overdue amount per day.
11.4. Prohibition of Harm to the Services and Staff. The User shall not abuse, threaten or insult the Service's staff and shall not cause harm to the Services in any form, including marketing, technical, image or reputational harm. The User shall not mislead others about the Services, including by impersonating the Service, falsifying transaction or account identifiers, falsifying screenshots or cloning the website. In the event of a breach, the Service may suspend the Personal Cabinet, freeze the Funds pending an investigation, restrict the use of the Services and take legal action.
11.5. The User shall indemnify the Service for any loss caused by the User's breach of these Terms or applicable law, including reasonable legal costs, fines and penalties. This provision shall survive termination of the agreement.
12. Service's Liability and Limitations
12.1. The Service provides the Services on an "as is" basis.
12.2. The Service shall not be liable for any loss arising from circumstances beyond its control, including:
- breach of confidentiality by the User, or unlawful acts of third parties using the User's details;
- viruses or malware on the User's equipment;
- disputes between Users, or between the User and a third party to whom the User made a payment;
- breach by the User of the laws of their country, or claims of tax or other authorities in connection with the User's transactions;
- the User's lack of the necessary hardware, software or internet access;
- the Service's inability to contact the User due to incorrect or out-of-date contact details;
- services provided to the User by third parties;
- third-party websites accessed by the User through links on the Website;
- temporary outages, technical faults or failures of power supply, networks or third-party systems not attributable to the Service.
12.3. Third Parties and Political Factors. The Service shall not be liable for acts or omissions of third parties or partners caused by political factors.
12.4. Acts of Authorities. The Service shall not be liable where acts of state or governmental authorities prevent the User from accessing the Personal Cabinet, Account or Card.
12.5. The Service shall not be liable for any loss arising from suspension, failed verification, an incorrectly completed Payment Order, the Service's compliance with the law, or the User's failure to read the current version of these Terms or the Internal Policies.
12.6. Where the Service's fault is established by a court, the Service's aggregate liability to the User shall be limited to the amount of the Service's charter (authorised) capital. The Service shall not be liable for indirect or consequential loss, including loss of profit, revenue, data or reputation.
12.7. The Service uses an artificial-intelligence-based automated assistant (the "AI Assistant") to provide consultations to Users. Responses of the AI Assistant are for information purposes only and may contain inaccuracies. They do not constitute an offer, guarantee, commitment or official position of the Service, nor do they amend or supplement these Terms or any other documents of the Service. In the event of any discrepancy between a response of the AI Assistant and these Terms, other documents of the Service, or an official response of the Service sent to the User by email following review of a request, the latter shall prevail. The Service shall not be liable for decisions made by the User solely on the basis of a response of the AI Assistant.
13. Privacy and Data
13.1. The processing of the User's personal data is governed by the Service's Privacy Policy and Cookie Policy published on the Website.
13.2. The Service retains records of the User's Personal Cabinet and transactions for as long as the Personal Cabinet remains open and, following its closure, for not less than 5 (five) years, or for a longer period where required by AML/CFT legislation or a competent authority.
14. Communications and Electronic Signature
14.1. The Service communicates with the User using the contact details provided by the User. Communications are conducted in English or Russian.
14.2. The User may contact the Service at any time through customer support in the application or at legal@gogocard.me.
14.3. The Service may notify the User of changes to the Services by email, in the application or on the Website.
14.4. Documents between the parties are exchanged electronically through the Personal Cabinet. Signing in with the Login Details constitutes a valid means of identifying the User and shall be deemed the User's signature for these purposes.
15. Inactive Personal Cabinets and Unclaimed Funds
15.1. In the event of no activity in the User's Personal Cabinet, or its non-use, for more than 90 (ninety) calendar days, the Service reserves the right to designate the User's Personal Cabinet, as well as the products and Funds held therein, as unclaimed.
15.2. The Service reserves the right to cancel the User's payment product (card) issued within a Personal Cabinet designated as unclaimed in accordance with clause 15.1, provided that the balance of Funds on such payment product (card) is 30 (thirty) US dollars or less. The balance of Funds on the cancelled payment product (card) shall be applied towards an administrative fee in an amount not exceeding 30 (thirty) US dollars.
15.3. Where the balance of Funds on the User's payment product (card) exceeds 30 (thirty) US dollars, the Service shall send the User a corresponding notice. In order to retain the payment product (card), the User must, within 14 (fourteen) calendar days from the date the notice is sent, log in to the Personal Cabinet and complete at least 1 (one) successful transaction using any of the User's active payment products (cards). Should the User fail to do so within the specified period, the balance of Funds on the payment product (card) shall be returned to the User's main Account (GoGoID) within 30 (thirty) business days.
16. Amendments to these Terms
16.1. The Service may amend these Terms by publishing an updated version on the Website. The Service shall notify the User of material changes in the Personal Cabinet at least 2 (two) months before they take effect.
16.2. Should the User disagree with an amendment, the User shall notify customer support before it takes effect, in which case these Terms shall terminate on that date. Continued use of the Services after an amendment takes effect shall constitute acceptance of such amendment.
16.3. Any appendices form an integral part of these Terms.
17. Termination
17.1. These Terms are concluded for an indefinite period and remain in force until terminated in accordance with this Section.
17.2. The User may terminate these Terms at any time by deleting the Personal Cabinet in the profile settings, provided that the User has no outstanding obligations to the Service. Once deletion has been initiated, no new transactions may be made; however, obligations arising prior thereto remain in effect until fully discharged.
17.3. The Service may terminate these Terms by giving the User 2 (two) months' notice. The Service may terminate these Terms without notice where the User rejects an amendment to these Terms (on the date such amendment takes effect), or upon the expiry of 3 (three) years following a suspension.

18.1. Neither party shall be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including natural disasters, acts of authorities, civil unrest, strikes, failures of power supply, internet or telecommunications, failures of third parties, and attacks such as DDoS or malware. The affected party shall notify the other party within 10 (ten) days.
18.2. Force majeure shall not release the User from the obligation to make payments or to pay any Fees or penalties due once such circumstances have ceased.
19. Governing Law and Dispute Resolution
19.1. These Terms and the relationship between the Service and the User are governed by the laws of Dominica.
19.2. The parties shall first seek to resolve any dispute by negotiation. Either party may send the other party a written complaint. Complaints are reviewed within 30 (thirty) days.
19.3. Where the dispute cannot be resolved by negotiation, either party may refer it to the competent courts of Dominica. This shall not affect any mandatory rights of the User under the laws of their country of residence.
20. Final Provisions
20.1. The User may not assign or transfer their rights or obligations under these Terms without the written consent of the Service.
20.2. Should any provision of these Terms be held invalid, the remaining provisions shall remain in full force and effect.
20.3. These Terms take effect when the User clicks "Open account" or makes their first transaction or deposit.
20.4. The User confirms that the provisions of these Terms are clear to them and that they accept the Internal Policies published on the Website.
